The emergency contact is simply a contact to call in case of emergency or hospitalisation, with no legal status. They cannot enter your room without your consent, cannot attend consultations, and their opinion carries no weight in medical decisions. The trusted companion, on the other hand, has a legally recognised status (Claeys-Leonetti Act 2016): they can accompany you at all consultations and help you assert your rights. The trusted companion has no legal power of decision: they accompany and inform, but you remain fully in charge. A guardian or curator, appointed by a judge, can act on your behalf. These are two very different roles. The trusted companion preserves your autonomy, it does not replace it.
All you need is a dated, signed document signed by both you and the designated person. This document can be given to your doctor, the hospital, or kept at home. Yes, at any time and without having to justify yourself. A simple written declaration is all it takes. This is a fundamental principle of this status: it serves your autonomy, not the other way around.
Yes, this is precisely one of my core roles. The law expressly recognises the right to be accompanied by your trusted companion at any medical consultation or hospitalisation. I rephrase, I note key information, and I make sure your questions are asked and heard.
No, and this is often a deliberate choice. Many people prefer a neutral, outside presence to avoid burdening their loved ones, to prevent family conflicts of interest, or to benefit from an objective perspective. Trusted companion and family complement each other. Some people designate me precisely to protect their loved ones from an emotionally overwhelming burden.
